Litigation

Trials and Appeals in South Carolina & Georgia State Courts, Federal Court and the U. S. Supreme Court

Litigation generally refers to a controversy before a court or a lawsuit. If parties to the lawsuit are unable to settle their differences by agreement, the suit would go to court where a judge and jury hears arguments from both sides and a decision is rendered. If either party is not satisfied with the outcome, an appeal may be taken to a higher court.

Controversies can arise between two individuals, an individual and a business, two or more businesses or two government entities in a broad scope of circumstances. Generally litigation is undertaken to reclaim money, property or services owed, but may also seek money damages or a specific action called an injunction or restraining orders.

Examples of circumstances that can lead to litigation include, but are not limited to:

  • Breach of Contract
  • Fraud
  • Divorce
  • Breach of Fiduciary Duty
  • Employment Agreements
  • Property Line Disputes
  • Regulatory Compliance
  • Misappropriation of Trade Secrets
  • Violation of Fair Trade Practices
  • Breach of Non-Disclosure Agreements
  • Recovery of Damages for Personal Injuries
